1. Introduction

Welcome to EV Compound ("EV Compound", "we", "us", "our"). EV Compound is an online subscription service that provides sports betting education, expected value analysis, and related tools to registered members in Australia.

By accessing or using the website located at evcompound.com (the "Platform"), or by registering as a member, you ("you", "the user", "the member") agree to be bound by these Terms and Conditions ("Terms"). These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and EV Compound.

2. Eligibility

You must be 18 years of age or older to use EV Compound. By registering or using the Platform, you confirm that you are at least 18 years old.

To use the Platform, you must:

• Be at least 18 years of age
• Be a resident of a jurisdiction where accessing sports betting information and EV analysis services is lawful
• Not be a person who is prohibited from gambling or accessing gambling-related services under applicable law
• Have the legal capacity to enter into a binding contract

EV Compound reserves the right to request proof of age at any time. If you are found to be under 18 years of age, your account will be immediately suspended and any subscription fees may be forfeited.

3. Nature of Our Service — Important Disclaimer

EV Compound provides educational content, expected value analysis, and betting tools. We do not provide financial advice, and our services should not be interpreted as a recommendation to place any particular bet or wager. Betting involves financial risk.

EV Compound is an educational and information service. Specifically:

• EV Compound identifies and presents betting opportunities where the odds offered by a bookmaker may represent positive expected value, based on our proprietary analysis.
• Our content is intended to educate members about value betting strategies and bankroll management principles.
• We do not guarantee that any tip, selection, or analysis will result in a profit.
• All betting involves the risk of financial loss, and positive expected value does not guarantee profit on any individual bet, or in the short term.
• Results vary between individual users and depend on factors including, but not limited to, bankroll size, account longevity, execution, and market conditions.
• Past performance (including any performance results referenced on the Platform) is not indicative of future results.

EV Compound does not hold an Australian Financial Services Licence (AFSL) and does not provide financial product advice within the meaning of the Corporations Act 2001 (Cth). Nothing on the Platform constitutes financial advice.

4. Account Registration

To access the full features of the Platform, you will need to create an account. When registering, you agree to:

• Provide accurate, current, and complete information about yourself
• Maintain and update your information to keep it accurate and complete
• Keep your login credentials confidential and not share them with any third party
• Notify us immediately at [email protected] if you suspect any unauthorised use of your account

You are responsible for all activity that occurs under your account. EV Compound reserves the right to suspend or terminate accounts that breach these Terms or that provide false registration information.

5. Subscriptions and Payments

Access to EV Compound's premium features is provided through a paid subscription.

5.1 Subscription Plans

EV Compound offers subscription plans as detailed on the Platform. Pricing, features, and plan availability are subject to change with reasonable notice.

5.2 Billing

Subscription fees are billed in advance on a recurring basis (weekly, monthly, or as per the selected plan). By subscribing, you authorise EV Compound (or its payment processor) to charge your nominated payment method for the applicable subscription fee on each billing date.

5.3 Free Trials

If EV Compound offers a free trial, your access will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

5.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation will take effect at the end of your current billing period. No refunds will be issued for partial billing periods unless required by applicable law.

5.5 Refunds

Except as required by Australian Consumer Law, subscription fees are non-refundable. If you believe you are entitled to a refund under the Australian Consumer Law (for example, due to a major failure of the service), please contact us at [email protected].

6. Responsible Gambling

EV Compound is committed to responsible gambling. We encourage all members to bet responsibly and within their means. If you feel that gambling is causing harm to you or someone close to you, please seek help immediately.

EV Compound strongly encourages members to:

• Only bet with money you can afford to lose
• Set strict personal limits on time and money spent gambling
• Never chase losses
• Never bet under the influence of alcohol or when emotionally impaired
• Take regular breaks from betting

EV Compound reserves the right to impose spending limits, restrict access, or suspend accounts where we have concerns about problem gambling behaviour.

7. Prohibited Conduct

By using the Platform, you agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Share your account credentials or allow any other person to access your account
• Copy, reproduce, redistribute, or resell any content from the Platform without our prior written consent
• Use any automated tools (bots, scrapers, crawlers) to access or collect data from the Platform
• Attempt to gain unauthorised access to any part of the Platform or its related systems
• Interfere with or disrupt the integrity or performance of the Platform
• Use the Platform if you are under 18 years of age
• Use the Platform in any jurisdiction where doing so is illegal
• Post or transmit any content that is defamatory, offensive, fraudulent, or in violation of third-party rights

8. Intellectual Property

All content on the Platform, including but not limited to text, data, software, graphics, logos, images, e-learning modules, tools, and methodologies, is the intellectual property of EV Compound and is protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform content for your own personal, non-commercial purposes only. This licence does not permit you to:

• Reproduce or distribute any Platform content to third parties
• Sell or commercially exploit any Platform content
• Modify, adapt, or create derivative works from the Platform content
• Share login access with third parties

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• EV Compound and its operators, partners, and staff are not liable for any financial losses, losses of profit, or consequential losses arising from your use of the Platform or from following any tips, strategies, or recommendations provided.
• EV Compound does not guarantee that the Platform will be available at all times, error-free, or that its content will be accurate, complete, or up to date.
• EV Compound is not responsible for the actions of any third-party bookmaker, betting exchange, or payment processor.
• EV Compound is not responsible for any decisions you make regarding gambling, betting, or financial matters.

Nothing in these Terms limits your rights under the Australian Consumer Law, including in respect of consumer guarantees that cannot be excluded by law. If EV Compound is found liable, our liability is limited to the subscription fees paid by you in the three months prior to the relevant event.

10. Indemnification

You agree to indemnify and hold harmless EV Compound, its operators, partners, affiliates, and employees from any claims, damages, losses, penalties, or costs (including legal costs) arising from: (a) your use of the Platform; (b) your breach of these Terms; or (c) your violation of any third-party rights or applicable law.

11. Third-Party Services and Bookmakers

The Platform may reference or link to third-party websites, bookmakers, or betting platforms. These third-party services are independent of EV Compound, and we have no control over their content, availability, or terms of service.

EV Compound does not endorse or guarantee any third-party bookmaker, and we are not responsible for any losses or disputes arising from your use of third-party platforms. You should always review the terms and conditions of any bookmaker or betting platform before depositing funds.

12. Losing Month Guarantee

The following conditions apply:

• You must have held an active, paid subscription for the entire calendar month (1st to last day). Partial-month subscriptions are not eligible.
• The guarantee is based on EV Compound's overall published tip performance for the month, not individual user results.
• A "losing month" means the total P&L across all published tips for the calendar month is negative.
• Refund requests must be submitted within 14 days of the end of the applicable calendar month by emailing [email protected].
• Refunds are issued to the original payment method and processed within 5–10 business days.
• This guarantee cannot be combined with the 7-day money-back guarantee or any other promotional offer.
• EV Compound reserves the right to modify or discontinue this guarantee with 30 days' notice to subscribers.

13. Modification of Terms

EV Compound may update or modify these Terms at any time. We will notify you of material changes via email or a notice on the Platform. Your continued use of the Platform following notification of changes constitutes your acceptance of the updated Terms. If you do not agree with any change, you should cancel your subscription and stop using the Platform.

14. Suspension and Termination

EV Compound reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms. If your account is terminated for a breach of these Terms, you will not be entitled to any refund of subscription fees paid.

You may terminate your account at any time by cancelling your subscription and deleting your account through the Platform settings.

15. Governing Law and Disputes

These Terms are governed by the laws of the state of Queensland, Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of that state.

Before initiating any formal legal proceedings, you agree to contact us at [email protected] to attempt to resolve any dispute informally.

16. Privacy

Your privacy is important to us. Our Privacy Policy, available at evcompound.com/privacy, explains how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

17. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EV Compound with respect to your use of the Platform and supersede all prior agreements, representations, or understandings.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
